Acceptance of Terms
By accessing or using Prastab (“the Platform,” “we,” “us,” or “our”) at prastab.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and Prastab. Please read them carefully before creating an account or submitting content.
Eligibility
You may use Prastab if you are:
- At least 16 years of age
- A citizen, resident, or visitor to Nepal, or someone with a legitimate interest in Nepal's civic affairs
- Not previously banned from the Platform for violations of these Terms
By using the Platform, you represent and warrant that you meet these eligibility requirements.
Use of Service
Prastab grants you a limited, non-exclusive, non-transferable license to use the Platform for its intended civic engagement purposes.
You may:
- Create an account and manage your profile
- Submit civic issues, proposals, and reports
- Vote on issues, comment, and engage in civic discussion
- Browse and search all public content
- Share content from the Platform on other platforms
You may not:
- Use automated tools (bots, scrapers) to access the Platform without prior written consent
- Attempt to reverse-engineer, hack, or compromise the Platform's security
- Use the Platform to interfere with political processes in a deceptive manner
- Create multiple accounts to manipulate vote counts
- Impersonate government officials, authorities, or other users
User Content
You retain ownership of all content you submit to Prastab (“User Content”). By submitting User Content, you grant Prastab a worldwide, royalty-free, non-exclusive license to:
- Display your content on the Platform
- Use your content in aggregated, anonymized statistics and reports
- Transmit your content to government authorities for civic accountability purposes
- Index your content to make it searchable
You represent and warrant that your User Content: (a) is accurate to the best of your knowledge, (b) does not infringe any third-party intellectual property rights, and (c) does not violate any applicable laws.
Prohibited Content
The following content is strictly prohibited on Prastab and may result in immediate account termination:
- False information — deliberately submitting fabricated civic issues or false reports
- Harassment — targeting individuals with threats, abuse, or sustained harassment
- Hate speech — content that discriminates or incites violence based on caste, ethnicity, religion, gender, or other protected characteristics
- Personal information — posting private information about others without consent (doxxing)
- Spam — repeatedly posting duplicate content or irrelevant commercial promotions
- Illegal content — content that violates Nepal's laws, including defamation, obscenity, or sedition laws
- Impersonation — falsely claiming to be a government official, authority, journalist, or other user
- Manipulation — coordinated inauthentic behavior, vote manipulation, or artificial amplification of content
Intellectual Property
The Prastab platform, including its source code, design, and branding, is licensed under an open-source license (see our GitHub repository). The Prastab name, logo, and visual identity are trademarks of Prastab and may not be used without written permission.
User Content remains the intellectual property of the respective authors. Prastab does not claim ownership of your submissions.
Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account at [email protected]
Prastab is not liable for any loss resulting from unauthorized access to your account due to your failure to protect your credentials.
Account Termination
Termination by You
You may delete your account at any time via Settings → Danger Zone. Upon deletion, your personal data is removed per our Privacy Policy.
Termination by Prastab
We reserve the right to suspend or permanently terminate your account if you violate these Terms. For minor violations, we will issue a warning first. For serious violations (hate speech, harassment, deliberate misinformation), we may terminate without warning.
You may appeal termination decisions by emailing [email protected] within 30 days.
Disclaimers
Prastab is provided “as is” without warranties of any kind, express or implied. We do not guarantee:
- That government authorities will act on any issue submitted through the Platform
- The accuracy of any information submitted by users
- Uninterrupted or error-free operation of the Platform
- That issues will be resolved within any particular timeframe
Prastab is a technology platform that facilitates civic communication. We are not a government body and have no authority to compel government action.
Limitation of Liability
To the maximum extent permitted by Nepal's laws, Prastab and its founders, employees, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Platform, including but not limited to:
- Loss of data or content
- Government inaction on submitted issues
- Reputational harm arising from public posts
- Any unauthorized access to your account
Our total liability to you for any claim shall not exceed NPR 5,000 (five thousand Nepali rupees).
Indemnification
You agree to indemnify, defend, and hold harmless Prastab and its team from any claims, damages, losses, and costs (including reasonable legal fees) arising from: (a) your use of the Platform, (b) your User Content, or (c) your violation of these Terms.
Governing Law (Nepal)
These Terms are governed by and construed in accordance with the laws of Nepal, including the Electronic Transactions Act, 2063 (2008) and the Consumer Protection Act, 2075 (2018).
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the District Court of Kathmandu, Nepal. Both parties agree to attempt good-faith mediation before initiating formal legal proceedings.
Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the “Last Updated” date at the top of this page
- Send an email notification to registered users
- Display a banner notification on the Platform for 30 days
Your continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
